‘We’ and ‘us’ refers to Garn Farm / Warmth & Wonder.
These Terms and Conditions form a legally binding contract between you (the Guest) and Warmth & Wonder at Garn Farm (the Owner) regarding your short-term rental stay at Garn Farm.
By confirming a booking, paying a deposit, or accepting a booking confirmation, you agree that you are over 18 years of age, and agree to these Terms and Conditions on behalf of yourself and all members of your party, and confirm you have read our Privacy Policy. The contract is for a holiday rental only and does not grant any rights under the Rent Act 1977 or the Housing Act 1988.
1. Booking and Payment
1.1 Contract of Hire & Booking Process
Our online booking system enables bookings 24 hours a day, providing you with an email confirmation. This confirmation is automated and does not constitute final acceptance by us. If we are unable to accept your booking, we will contact you within 24 hours. Phone or email enquiries will only reserve dates for 5 days without receipt of payment.
1.2 Deposit and Balance
- Initial Deposit: A non-refundable deposit of 25% of the total rental cost is required to secure the booking if the arrival date is more than 8 weeks away.
- Balance Payment: The full outstanding balance must be paid 8 weeks in advance of the arrival date.
- Late Bookings: For all bookings made less than 8 weeks before arrival, full payment is due immediately upon booking.
- Failure to Pay: Non-payment of the balance by the due date shall be construed as a cancellation by the Guest, and the cancellation policy (Section 2) will apply.
- Payment Methods: Payments can be made via bank transfer, electronic card payment via our booking system using Stripe, or cheque.
1.3 Pricing and Minimum Stay
- Pricing: The rental price includes reasonable use of utilities, bed linen, and towels. The price does not include travel insurance or food. The Owners reserve the right to amend advertised prices at any time and correct errors in confirmed prices.
- Minimum Stay: Standard bookings are: 3 Nights Weekend (Friday to Monday) or 4 Nights Midweek (Monday to Friday). Week Stays are 7 Nights (Monday or Friday check-in). We may offer flexibility if arranged prior to booking.
1.4 Special Requests
If you have any special requests (e.g., access requirements, specific room setups), please notify us at the time of booking. While we will make every effort to meet such requests, they are not guaranteed, and we have no liability to you if they cannot be met.
2. Cancellations and Refunds
2.1 Guest Cancellation
Cancellations must be notified to the Owner immediately by telephone or email, followed by a confirmatory letter or email.
- All deposits are non-refundable.
- Cancellations made within 8 weeks of the check-in date will result in the forfeiture of all monies paid (100% of the total booking cost).
- Re-Letting: Upon receiving written cancellation, we will endeavour to re-let the property. If a replacement letting is successfully obtained, we will refund any monies paid (less the non-refundable deposit). If we are unable to re-let, we shall retain all payments already made.
- Transfer Booking: You may transfer your balance to a new booking if you cancel at least 8 weeks prior to your original holiday and re-book.
Note: We strongly recommend that the Guest takes out comprehensive travel insurance, including cancellation cover, to protect against unforeseen circumstances.
2.2 Owner Cancellation
If, for any reason beyond our control, the property is not available on the date booked (e.g., fire, flood, or damage making the property uninhabitable), all rent paid in advance will be refunded in full. The Guest shall have no further claims against Garn Farm / Warmth & Wonder.
3. The Stay: Guest Obligations & Safety
3.1 Arrival and Departure
- Check-in: The property will be available from 4:00 PM on the arrival date. Latest check-in is 8:00 PM.Flexibility outside these times must be arranged beforehand.
- Check-out: The Guest must vacate the property by 10:00 AM on the departure date. Failure to vacate on time may result in an additional charge.
- Parking: Two car park spaces are provided adjacent to the property. If you require additional spaces, this must be agreed with the Owners beforehand.
3.2 Care and Cleaning of the Property
The Guest agrees to take all reasonable and proper care of the property and its contents. The property must be left in a clean and tidy condition, with particular attention given to the kitchen, equipment, and utensils. The Guest is responsible for any additional cleaning costs incurred.
3.3 Damage and Breakages
The Guest is legally responsible for any damage or breakage caused to the property, contents, or grounds during their stay. Costs for repair or replacement will be charged to the Guest.
3.4 Maximum Occupancy & Group Bookings
The number of persons occupying the property must not exceed the maximum number stated in the booking confirmation. Group bookings (including single-sex groups like stag/hen parties) must be agreed with the Owners beforehand and confirmed in writing. Failure to adhere to agreed numbers may result in the termination of the hire without notice or refund.
3.5 Noise and Conduct
Guests must not cause annoyance or nuisance to neighbours or other occupiers of the locality. Outside noise immediately around The Barn and Farmhouse must be kept to a minimum after 10:00 PM.
3.6 Smoking and Pets
- Smoking: Smoking is NOT allowed in or immediately outside The Barn or any indoor communal areas. Breach of this term will result in a cleaning surcharge.
- Pets: Dogs are not allowed at The Barn as we are a working farm with livestock.
3.7 On-Site Safety (Hazards & Supervision)
Every reasonable effort has been made to indicate possible safety hazards, but it is the Guest’s responsibility(particularly parents with young children) to inspect the property and grounds immediately on arrival and note any hazards. Check the layout of the property so that in an emergency you can get out quickly and easily.
- Sleeping Platform: The platform is reached by a steep ladder-stair and has restricted head space. It is not suitable for children under 12 years. It must be used with care, going up and down facing forwards.
- Open Water: There are streams and an unfenced pond with open water nearby The Barn and across the land. Children playing outside must be supervised at all times.
- Land and Woodland: The woodland and fields are open for exploration, but the land and paths are steep in places and may not be accessible for everyone. You explore the land at your own risk.
3.8 Sauna & Cold Plunge Use
Use of the wood-fired sauna and cold plunge facilities, if booked, is subject to the Sauna Use Terms, Conditions, and Guidelines provided separately, which must be agreed to prior to use.
3.9 Linen and Amenities
Bed linen, bath towels, hand towels, and tea towels are provided.
- Bed Configuration: Beds can be made up as doubles or twin singles. You must advise us of your preferred configuration when booking. If no request is made, the default configuration will be provided.
- Cot Linen: Cot linen is NOT provided, and guests must bring their own.
3.10 Firewood Use
A reasonable supply of firewood for the wood stove is included in your rental price for typical use. Should you require additional supplies beyond this initial allowance, please ask the Owners. Further supplies are available upon request and may incur an additional fee.
3.11 Owner Presence
The Owners live on site. We aim to welcome you shortly after your arrival and are generally available throughout your stay, either in person or by phone, for any assistance or advice. As we share the land, we appreciate you respecting our privacy while you enjoy your stay.
4. Owner’s Rights and Liability
4.1 Right of Entry
The Owner or their representative shall be allowed reasonable access to the property to carry out urgent maintenance or essential checks. Where possible, prior notice will be given to the Guest.
4.2 Right to Terminate
The Owner reserves the right to terminate the hire without notice and without refund in the case of a serious breach of these Terms and Conditions by the Guest (e.g., exceeding occupancy limits, illegal activity, or causing excessive damage/nuisance).
4.3 Owner Liability
The Owner accepts no liability for any loss, damage, injury, or accident to the Guest or any member of their party, their property, or their vehicles, however caused, whilst staying at Garn Farm.
4.4 Complaints
It is essential that you contact us immediately if any problem arises so that it can be speedily resolved while you are in residence. If after this you feel the complaint remains unresolved, you must notify us in writing within 7 days of returning from your holiday.
5. Governing Law
The contract of hire is governed by the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the English and Welsh courts.
